جـرم‌انگـاری تهاجمـی فرانسـه در جرائم تروریستی

چکیده

استراتژی عقب‌نشینی حقوق کیفری،حاصل جنبشی بود که از سال 1975 در کشورهای اروپایی به وجود آمد. مهم‌ترین ثمره این جنبش، جرم‌زدایی از اعمالی شد که تا آن زمان وصف مجرمانه داشتند. از این‌رو جرم زدایی به همراه دو راهکار دیگر ـ قضازدایی و کیفرزدایی ـ مهم‌ترین سیاست کیفری کشورهای اروپایی برای تبعیت از استراتژی مذکور بوده است.
با این همه سیاست کیفری مذکور کلیت و عمومیت نسبت به همه جرائم نداشته است. جرائم تروریستی از جمله جرائمی است که دامنه جرم‌انگاری آن در دهه‌های اخیر در فرانسه و نیز در سایر کشورهای اروپایی، توسعه قابل ملاحظه‌ای یافته است.
در این نوشتار با تکیه بر متون قانونی فرانسه سعی گردیده، وجود چنین جرم‌انگاری تهاجمی نسبت به جرائم تروریستی در فرانسه به اثبات برسد

Offensive Decriminalization in the Field of Terrorist Acts in France

چکیده English

The retreat strategy of penal law was the result of a movement happened in European countries in 1975. Decriminalization of some criminal acts was the most important result of this movement.Consequently, the most important European countries penal policy in line with the mentioned strategy was decriminalization, in addition to two other approaches– diversion and depenalization.

particular area disclose a genuine need for a specialized court? How have the problems been dealt with before the courts? Has there been any important legislation that has prompted or will prompt an increase in the number of cases being litigated in this area over a period of time? Is the volume or potential volume of work in this area sufficient to justify the creation of a specialist court?
In this article I study privileges and defects related to specialized IP courts and also discuss the emerging worldwide trend to establish specialized IP courts and the impact of the specialized IP courts on the protection and enforcement of IP rights and also obstacles related to their creation.
