بررسی ماهیت و مبانی حقوقی تایم شرینگ (مالکیت زمانی) در حقوق انگلیس

چکیده

نوشتار حاضر بر آن است تا مالکیت زمانی را با دقت در عناوین مالکیت قانونی و انواع مالکیت اشتراکی در حقوق انگلیس را که یکی از پیشگامان استفاده از مالکیت زمانی درنظام حقوقی کامن لو و در جهان می‌باشد، بررسی کند. در حقوق انگلیس مالکین تایم شرینگ دارای نوعی مالکیت مطلق و بدون قید و شرط هستند، چرا که دارای تمامی حقوق مالکانه نسبت به ملک خود بوده و امکان اعمال و اجرای آن را با رعایت محدوده زمانی مالکیتشان، نسبت به مملوک خود دارا می‌باشند.
اگر چه این نوع مالکیت محدودیت‌هایی را به دنبال دارد، این امر نافی ماهیت حقوقی آن و مالکیت مطلق افراد نسبت به اموال خود در زمان مالکیتشان نمیباشد.
از آن‌جا که در مفهوم این نوع مالکیت، نوعی اشتراک وجود دارد و حتی ظاهر کلمه Time-sharing نیزبه مفهوم نوعی شراکت میباشد، این تأسیس جدید بر پایه حقوق اشتراکی استوار گشته و به اقتضای وجود انواع تایم شرینگ، مبانی جداگانه‌ای دارد. یک قسم از این نوع مالکیت یعنی دارا شدن عین برای دوره یا مدت زمان معین بر مبنای مالکیت مشترک (Tenancy in Common) بوده و نوع دیگر آن به معنای دارا شدن منفعت به تبع عین برای دوره یا مدت زمان معین بر پایه مالکیت اشاعی (Joint Tenancy) استوار است.

چکیده English

This essay illuminates the legal nature and the rudiments of Time- Sharing contracts in the British legal system as one of the pioneers of using it in the world, focusing on different kinds of legal estate and co-ownership in the British law. According to the British law, the owners of Time-Sharing have a kind of Fee Simple Absolute in Possession regarding their property. Thus, they have the executive right for their belongings. Although such an ownership embodies some limitations, its legal nature does not change and it does not deny Fee Simple Absolute in Possession of the owners. As the name expresses, Time-Sharing indicates a kind of sharing and partnership and its elements have been based on sharing laws. Since there are different kinds of Time-Sharing, for either of each exists variable elements. As a result, there are two kinds of Time-Sharing. The first is ownership of the property in a certain period of time on a Tenancy in Common basis. The second is sharing the interest and the benefit of the property in a certain period of time on the basis of a Joint Tenancy.
