جایگاه و نقش رئیس‌جمهور در نظام‌های مختلف جمهوری

چکیده

در هر مطالعه حقوقی راجع به نهادهای سیاسی آنچه در درجه اول اهمیت قرار دارد، بررسی نقش و کارکرد ساختارهای رسمی چونان پدیده‌ای حقوقی در متن آرایش نیروهای اجتماعی در جامعه سیاسی است، تا بلکه بتوان از شمای مفروض نظام سیاسی، آن گونه که در قانون (اساسی) توصیف شده، در پرتو متغیرهای بیرونی به توصیف و تبیین شکل و کارکرد نظام سیاسی واقعاً موجود دست یافت. بنابراین پیش از هر بحث حقوقی راجع به جایگاه و نقش رؤسای جمهور ابتدائاً باید مجموعه عوامل نهادی و غیرنهادی، فردی و اجتماعی که در توصیف و تبیین عینی یا علمی موضوع نقش دارند را از هم بازشناخت. متغیرهای مزبور در تبیین یافته‌ها و داده‌های موجود راجع به جایگاه و مصادیق نقش‌هایی که رؤسای جمهور در رژیم‌های سیاسی مختلف (از جمله رئیس‌جمهوری اسلامی ایران) رسماً یا عملاً برعهده دارند، به ما کمک می‌کند. در این میان بررسی عوامل و متغیرهایی همچون نحوه انتخاب رؤسای جمهور، موقعیت رسمی و جایگاه قانونی آن‌ها، وظایف و در عین حال مسئولیت‌ها و مصونیت‌هایی که رؤسای جمهور از آن برخوردارند می‌تواند به نوبه خود ما را در شناخت کارکردها و نقش‌های منصب ریاست جمهوری در نظام‌های مختلف یاری دهد.

The Status and Functions of the President in Different Presidential Systems

چکیده English

In any legal study on political institutions, what has priority is to examine the role and functions of the official structures as legal phenomena in the context of social forces in political society so that, through studying the political regime as described in the constitution in the light of external variables, the political regime as actually exists could be explored. Thus before embarking on any legal study on the status and functions of the presidency, a distinction must be recognized between institutional factors and non-institutional ones, individual elements and social ones that play a role in the scientific study. These variables help us illustrate existing data and findings on status and the functions the president has, officially or actually, in different political regimes (including the president of the Islamic Republic of Iran). Amongst these, factors such as how to elect the president, the official status of president, presidential powers as well as duties and immunities, in turn, may contribute to understanding the office of the presidency in different presidential regimes.
