چکیده

رأی دیوان دادگستری اروپا در قضیه کادی، مبتنی بر برتری دادن استانداردهای حقوق بشری بر ضمانت اجرای اتخاذ شده توسط شورای امنیت می‌باشد. اعضای ملل متحد در حالی که به طور کامل در قبال قطعنامه‌های شورای امنیت ملتزم می‌باشند، در صورت تعارض میان ایفای این تعهدات و اِعمال حقوق بشر بنیادین افراد بر طبق حقوق اتحادیه اروپا، از اجرای بخشی از قطعنامه مذکور معاف می‌باشند. تأکید ماده 103 منشور ملل متحد بر جایگاه منشور، به عنوان قواعد برتر جامعه بینالمللی، نباید ما را از توجه به اهمیت سایر قواعد حقوق بین‌الملل از جمله قواعد حقوق بشری غافل سازد. بنابراین در صورت وجود تعارض میان قطعنامه‌های شورای امنیت و حقوق بنیادین بشر بر طبق کنوانسیون اروپایی حقوق بشر، نه اتحادیه اروپا و نه دولت‌های عضو آن مجاز به اجرای قطعنامه‌هایی که منجر به نقض حقوق بنیادین که در نظام حقوقی مستقل اروپا تضمین شده است، نمی‌باشند.

چکیده English

The United Nations Security Council is the most powerful institutional body ever established at the global level. In today’s international law, there can be little doubt that the international community as a whole attaches special importance and effects to peremptory norms of general international law (jus cogens) and endows them with high status. The interaction between those high-ranking norms and the powers of the Security Council is therefore among the most central issues of international law.
Respect to fundamental Human Rights is jus cogens. The Security Council can never be entitled to infringe upon human rights embodied in universal human rights instruments.
Kadi decision has given preference to human rights standards over United Nations Security Council (UNSC) sanctions stemming from the Resolution 1267 (1999) sanctions regime. This study subsequently illuminates how the respective human rights limits to the Security Council’s enforcement powers could be enforced by judicial review
