صیانت از حریم ژنتیکی در دَوَران منافع فردی و مصالح عمومی

چکیده

هر چند کاربرد اطلاعات ژنتیکی به منظور پیشگیری و درمان بیماری‌ها و همچنین استفاده فزاینده از این اطلاعات در حوزه‌های غیرپزشکی، نظیر اشتغال، بیمه، مراجع قضائی و یا نهادهای آموزشی و پژوهشی، منافع اقتصادی و اجتماعی غیرقابل انکاری به همراه دارد؛ اما چالش‌های حقوقی و اخلاقی بسیاری را، از جمله مخاطرات ناشی از نقض حریم ژنتیکی و اعمال تبعیضات ناموجه، به وجود آورده است. تعارض حق حریم خصوصی اشخاص با دیگر حقوق متقابل، اعم از حفظ حیات و سلامت سایرین و یا تأمین منافع عمومی برتر، نظیر نظم، امنیت و سلامت جامعه مستلزم اتخاذ رویکردی مناسب در برقراری توازن میان حمایت از حریم خصوصی و همچنین لزوم دستیابی معقول و ضروری به اطلاعات ژنتیکی می‌باشد. نوشتار حاضر به ارزیابی زمینه‌های تعارض و پیامدهای مثبت و منفی کاربرد اطلاعات ژنتیکی در حوزه‌های گوناگون پرداخته و بر لزوم رفع خلاءهای قانونی و وضع قواعد حقوقی جامع و کارآمد، همزمان با آموزش عمومی و افزایش آگاهی و اعتماد جامعه تأکید می‌ورزد

چکیده English

Social interests lied in the use of genetic information for prevention and treatment of diseases and their economic benefits in non-medical areas such as employment, insurance, judicial procedures or educational and research institutions are undeniable. Yet, these utilizations have posed some legal and moral challenges with regard to genetic privacy and unfair discriminations. Solving the conflict between genetic privacy and public mutual interests requires an appropriate way towards equalizing the respect of privacy and the essential access to genetic information. In this essay, the main grounds of this conflict and the positive/negative consequences of enjoying from genetic information in various fields are considered. To solve the conflict writers suggest enacting suitable laws and regulations and promoting public trust and awareness among citizens
