مواجهه با تروریسم رویکرد نظامی, سیاسی و یا حقوقی

چکیده
تروریسم پدیده جدیدی نیست، تاریخ مشحون از اقدامات شوم تروریستی است که با انگیزه های گوناگون ارتکاب یافته و حیات انسان­های بی­گناه بی­شماری را سلب نموده و حقوق، آزادی­ها و امنیت مردم را به مخاطره افکنده است. امروز اما تروریسم از تهدیدی ملی به یک تهدید بین المللی تبدیل شده و خوف آن وجود دارد که با گسترش آن صلح و امنیت بین المللی به مخاطره افتد.
 نگارنده با نگاهی به علل ارتکاب ترور توسط افراد یا گروه­ها، راه­های مقابله با آن را مورد توجه قرار داده، از سه پارادایم نظامی(جنگ)، سیاسی و حقوقی سخن گفته و این نتیجه را به دست داده است که باید به رویکرد قانون و اجرای آن در داخل کشورها و نیز صحنة بین المللی توجه بیشتری مبذول نمود و نیز عند الاقتضاء از دیپلماسی مذاکره بهره برد و نباید با اعمال خشونت و جنگ در انتظار نابودی تروریسم نشست و در جایی که راهی جز مبارزة نظامی باقی نیست و با نظارت مجامع بین المللی جنگی افروخته می‌شود، رعایت حقوق بشر دوستانه الزامی است؛ چنان­که محاکمه متهمانِ به ارتکاب جرایم تروریستی در محاکم داخلی یا بین المللی, مستلزم رعایت حقوق متهم و تحقق محاکمه­ای منصفانه است.

Response to Terrorism: Military, Political or Legal Approach?

چکیده English

Terrorism is not a new phenomenon; history is replete with heinous terrorist acts perpetrated out of various motives which have taken the lives of countless innocent persons and endangered the security of the people. Now the threat has turned from national to international and there is the fear that its expansion will peril international peace and security.
The author looks at reasons of terrorist acts, considers possible responses to them and after pointing out to three military, political and legal paradigms, concludes that the legal approach and its implementation within states as well as in international arena commands more attention, while negotiation diplomacy must be pursued when necessary. The article proposes that violence should not be expected to eradicate terrorism and when there is no way other than military and a war is waged under the supervision of international bodies, humanitarian laws and regulations are binding; thus in prosecuting those accused of terrorist crimes in national or international tribunals, the rights of the accused and the rules of fair trial must be observed.
