چکیده

در این مقاله نگارنده ضمن برشمردن فهرستى از حقوق و آزادیهاى بنیادین انسانى، از جهان شمولى این حق‏ها در برابر ایده مطلق گرائى دفاع کرده است. تفکیک بین دو ایده جهان شمولى و مطلق گرائى و دفاع از ایده جهان شمولى حق‏ها و آزادیهاى مقید، از نقطه نظر اخلاقى در مقابل ایده نسبیت فرهنگى از دست‏آورد اصلى این مقاله است؛ همچنین تفکیک بین حق هاى کلان و خرد در جهت توجیه تکثر و تنوع فرهنگى و نه نسبیت فرهنگى با طرح جهان شمولى حق‏هاى کلان و یا بنیادین در برابر حق‏هاى خرد، در جهت تبیین مفهوم جهان شمولى و دفاع از آن ارائه شده است. همچنین با طرح مسأله تزاحم حق‏ها، ضمن پذیرش تحدید حق‏ها از جهان شمولى حق‏هاى مقید دفاع شده است. ارائه طرح قابل دفاعى در حل مسأله تعارض و تزاحم حق‏ها در جهت تبیین قلمرو حق‏ها از دست آوردهاى این مقاله است

چکیده [English]

Having offered a list of fundamental rights and freedoms, in this article I have argued in favor of their universalism v. their absoluteness. Making a justified distinction between two ideas of universalism and obsolutism and then advocating the idea of universality of certain morally restricted rights and freedoms against the idea of cultural relativism are the main achievements of this article. Also by distinguishing between macro and micro rights, I have attempted to justify sort of cultural pluralism in interaction with the idea of universalism. Offering a justified solution to solve the problem of the conflict of rights is another issue touched by the writer to define scope of certain universal rights and freedom
