بررسی تطبیقی نظام حقوقی حاکم بر حمایت از آثار چند رسانه ای

چکیده

آثار چندرسانه‌ای از جدیدترین محصولات فکری فن‌آورانه در دو دهه اخیر محسوب می‌شوند که توانسته‌اند به علت خلاقیت و نوآوری بالا، در مدتی کم بازارهای بین‌المللی را به طور موفقیت‌آمیزی به قبضه خود درآورند. این آثار که ناشی از تراوش فکری افراد هستند به یقین ذیل چتر حمایتی نظام حقوق مالکیت فکری قرار می‌گیرند؛ اما مسئله اصلی تعیین نوع نظام حمایتی حاکم بر این آثار است. در این مقاله سعی شده است تا ضمن تأکید بر مطالعه تطبیقی، اولاً ماهیت حقوقی و فنی این آثار فکری جدید و عواملی که باعث انفکاک آن‌ها از سایر آثار فکری موجود می‌شود مشخص گردد و سپس فرآیند حمایت از آثار چندرسانه‌‌ای مورد بررسی قرار گیرد و مشخص شود آیا امکان حمایت از آثار چندرسانه‌ای با توجه به قوانین کنونی مالکیت فکری در کشورهای مختلف وجود دارد یا خیر؟

A Comparative Analysis of the Legal Regime of Multimedia Works

چکیده English

Multimedia works are conceived as the newest technological products in recent decades and because of their high innovation and resourcefulness, they have had the ability to capture international markets in a short time. Such works that stem from intellectual efforts of human being is certainly protected by intellectual property law, however the main issue is to determine a legal regime for the protection of these works.
Adopting a comparative approach, this article is to firstly specify the legal and technical nature of such new works and the factors caused them to be separated from other existing intellectual works and secondly to investigate the process of protecting multimedia works to be finally discerned whether or not there is the possibility to protect multimedia works based on current intellectual property laws in different countries.
