دکترین دادگاه نامناسب در حقـوق بین‌المـلل خصوصـی

چکیده

قواعد صلاحیت قضایی جزو قواعد آمره است که بر اصحاب دعوی و بر مرجع رسیدگی تحمیل می‌شود. اصحاب دعوی به غیر از چارچوب خاص شرط صلاحیت امکانی برای تعیین یا تحدید صلاحیت قضایی ندارند. مرجع رسیدگی نیز نمی‌تواند آنچه را که بر حسب مقررات به وی اعطاء شده است، فروگذارده و از رسیدگی به دعوی استنکاف ورزد. با این وجود مطالعه سیستم‌های حقوقی مختلف به خصوص نظام کامن‌لا مبین تجویز سنجش مصلحت در اعمال صلاحیت قضایی است. به طوری که دادگاه مجاز است با ارزیابی منافع عمومی و خصوصی از اعمال صلاحیت خودداری کرده و خواهان را به دادگاهی دیگر در کشور دیگر هدایت نماید.

Forum Non-Conveniens Doctrine in Private International Law

چکیده English

Rules of jurisdiction are among mandatory rules imposed on both litigants and the court. Litigants have not any way for determination or delimitation of jurisdiction, except in the special framework of jurisdiction clauses. Also the court cannot leave what is entrusted to it by regulations and jurisprudence. However, a study of different legal systems, in particular Common Law system, is indicative to permission of expediency examination in the exercise of jurisdiction. Thus the court is permitted to take account of public and private interests and decline from jurisdiction and direct the parties to another court in another state.
