چکیده

باتوجه به اهمیت نحوه حل و فصل اختلافات مربوط به حقوق مالکیت معنوی و تأثیر آن در حمایت از این حقوق، این سؤال اساسی مطرح است که آیا با ایجاد تریپس و پیش­بینی رکن حل اختلاف (که مکانیزمی بسیار دقیق و کارآمدی در رابطه با حل و فصل اختلافات مربوط به مالکیت­های معنوی  تعبیه نموده و سعی می­کند با توسل به شیوه شبه قضایی این گونه اختلافات را حل و فصل نماید)، مرکز داوری و میانجیگری وایپو (که عمدتاً غیر قضایی بوده و فاقد رکن اجرایی قوی می­باشد)، اهمیّت خود را از دست داده است؟ آیا می­توان اذعان نمود که شیوه­های حل و فصل واپیو به­طور غیرمستقیم متروک و از کار افتاده شده است؟ یا این که پاسخ منفی است؟ فرضیّه نگارنده در این زمینه این است که با ایجاد تریپس، وایپو اعتبار خود را از دست نداده است و در کنار آن همچنان در حل و فصل اختلافات مربوط به مالکیت  معنوی نقش مهمی را ایفا می­نماید.

A Study of the Manners of Settlement of Intellectual Property Disputes in the WIPO and TRIPS

چکیده [English]

The WIPO and TRIPS have special manners for the settlement of intellectual property disputes. The WIPO Arbitration and MediationCenter, settles such disputes by Alternative Dispute Resolution Manners (ADR). On the basis of WTO Understanding on Rules and Procedures Governing the Settlement of Disputes, such disputes will be settled by quasi-judicial manners. In this Article we study privileges and defects, preferred manners and analyze possibility or impossibility of resorting to both mecanisms, in order to achieve a satisfactory settlement of disputes relating to intellectual property matters.
