بررسی مفهوم، جایگاه و نمادهای حقوق فولکلور

چکیده
" فولک" (Folk) به معنی "مردم" و "لور" (Lore) به معنی "دانستنی‌ها" و "علم" به کار می‌رود و کلمة فولکلور (Folklore) در مفهوم اصطلاحی به معنی فرهنگ و دانش بومی بوده و عبارت است از مجموعه آثار و خلاقیت‌های یک قوم یا گروه مشخص و معین و یا به وسعت یک ملت که مشتمل بر ارکان ملموس و عینی و غیرملموس مثل محصولات ادبی و هنری، عقاید و آداب و رسوم، دانش و تکنولوژی و طبابت بومی و... می‌باشد و اصولاً دارای ویژگی‌های دیرینگی، قلمرو معین و شیوة رفتار است. قلمرو حقوق فولکلور نیز به طور کلی در بر گیرندة «فولکلور هنری»، «تکنولوژی و علم بومی» ، «ادبیات عامه (بومی)»، «عادات و رسوم و رویه‌های معمول عامه» است. «حقوق فولکلور» که وظیفة شناسایی و حمایت مفهوم و نمادهای «فولکلور» را برعهده دارد، باعث به وجود آمدن تلاش‌های ملی، منطقه‌ای و بین‌المللی گشته که از ضرورت توجه به این شاخه از جامعه‌شناسی حقوقی نشأت می‌گیرد.
در مقاله حاضر تلاش شده است تا تعریف دقیق و متناسبی از «فولکلور» و نمادهای آن ارائه شود و جایگاه بحث با شناسایی «حقوق فولکلور» شکل گیرد. سپس تلاش‌های ملی، منطقه‌ای و بین‌المللی را در این رابطه تحلیل کرده و به اقدامات درخور سازمان وایپو و یونسکو در پیش بینی مقررات نمونه سال ۱٩۸۲ دربارة فولکلور و بررسی قانون حمایت از مؤلفان و مصنفان و هنرمندان (مصوب 1348) می‌پردازد.

چکیده English

Folklore consists of two separate words, "folk" and "lore". "Folk" means people and "lore" means knowledge. Generally, the folklore expressions consist of culture and traditional knowledge. On the other hand, we can define folklore as a collection of works and creations of a certain group or ethnic that may belong to a nation, consist of tangible and intangible elements, such as, literature and artistic works, folk beliefs, practices, knowledge, technology, folk medicine and etc.
Principally, the characteristics of folklore are longtime, special domain and approach of behavior. The scope of the law of folklore, generally, consists of artistic folklore, traditional technology, folk literature and folk practices. The role of folklore law is identification and protection of expressions of folklore. However, in this article we try   to offer a suitable definition for folklore and expressions of folklore. Then, we examine the national, regional and international efforts in relation to folklore, for example, "Model Provisions"(1982) made by UNESCO and WIPO and Copyright Law of Iran (1348).
