گذر از «زمان» در ایجاد قاعدۀ حقوق بین‌الملل عرفی: واکاوی انگاره‌های حقوقی و رویه دیوان بین‌المللی دادگستری

چکیده

مطالعه تطبیقی جایگاه «زمان» در ایجاد قاعدۀ حقوق بین‌الملل عرفی‌ نشان از وجود نظراتی متمایز، متعارض و حتی متناقض دارد. با توجه به اینکه وجود عنصر مادی، یعنی رویه عام و عنصر معنوی، یعنی پذیرفته شده به عنوان حقوق که از آن به باور حقوقی نیز یاد شده است، لازمۀ تشکیل حقوق بین‌الملل عرفی دانسته می‌شوند، پژوهش پیش‌رو بر آن است تا به این سؤال پاسخ بدهد که جایگاه «زمان» در تکوین و به دنبال آن، شناسایی قاعدۀ حقوق بین‌الملل عرفی چیست؟ با توجه به اینکه رویه قضایی بین‌المللی و آموزه‌های حقوقی برجسته‌ترین حقوقدانانِ ملل مختلف، به منزلۀ وسایل فرعی برای تعیین قواعد حقوقی است، جستار حاضر با مطالعۀ رویه دیوان بین‌المللی دادگستری و همچنین برجسته‌ترین آثار اندیشمندان این حوزه و مطالعات گزارشگر ویژۀ کمیسیون حقوق بین‌الملل به عنوان مهم‌ترین نهاد تدوین و توسعه تدریجی این زمینه از حقوق، به تحول در این مفهوم پی برده و ضمن تبیین نظرات سنتی و نوین، مطرود را از پذیرفته شده تمییز داده و در نهایت ثابت می‌کند که زمان، عاملی است که به دو رکن لازم برای ایجاد آن، قوام می‌بخشد؛ عامل زمان در شکل‌گیری قواعدی از این دست ضروری می‌نماید، اما طول مدت در خصوص هر قاعده عرفی نسبت به مورد دیگر متفاوت است.

چکیده English

Comparative Study of the role of ‘Time’ in the formation of Customary International Law, shows the different, contradictory and even conflicting ideas. Being necessary the existence of the objective element, i.e. general practice, and the subjective one, i.e. accepted as law, so called opinio juris, for the formation of such rules in international law, the present paper seeks the following question that what and how is the role of ‘Time’ factor in formation and subsequently identification of rule of customary international law? As international judicial decisions and teachings of the most highly qualified publicists of various nations have been considered as the subsidiary means to identifying legal rules, the present paper studied the jurisprudence of International Court of Justice and teachings of the most highly qualified publicists of this field, and studies of International Law Commission reporter as the most important entity in the codification and progressive development of international law and figured out there has been a conceptual evolution in the said conception. Explaining the classical and current ideas in question, distinguishes the outcasted concepts from the accepted one and finds that the time factor affects the two said elements in Customary International Law. The time factor is necessary in the formation of such rules, but the period of this time is and must be different by virtue of each case.
