چکیده

مقالة حاضر ضمن تحلیل و بررسی ابعاد حقوقی، تاریخی و فلسفی مادة 9 و بند (ج) ماده38 (1) اساسنامة دیوان بین‌المللی دادگستری، در تلاش است رویة قضایی دیوان را نسبت به ظرفیت‌های نظام حقوقی اسلام بررسی و تحلیل کند. از سال1969 توجه دیوان و قضات آن به حقوق اسلام افزایش یافته است. در متن دو رأی و نیز در نظرات جداگانه و مخالف تعدادی از قضات به ارتباط قواعد و اصول اسلامی با مفاهیم حقوق بین‌الملل پرداخته شد. دیوان بر اساس مادة 50 اساسنامه می‌تواند با استفاده از کارشناسان به مطالعة تطبیقی قواعد و اصول اسلامی با مفاهیم حقوق بین‌الملل بپردازد. از این طریق هم بر غنای آرا و احکام دیوان و نظرات جداگانة قضات در بارة حقوق اسلام خواهد افزود و هم فرصتی برای رهیافت‌های این نظام حقوقی در توسعة حقوق بین‌الملل و حل و فصل اختلافات بین‌المللی خواهد بود.

چکیده [English]

Analyzing and dealing with historical, legal and philosophical aspects of articles 9 and 38(1) (C) of International Court of Justice Statute, present paper tries to explore the procedure of ICJ for capacities of Islamic Legal System. Since 1969 ICJ and its judges have paid increasing attention to Islamic Law.  In the text of two judgments and also different and contradicting opinions of a number of judges, the relationship between Islamic rules and principles and International Law concepts have been discussed. ICJ, based on article 50 of its statute can do a comparative study between Islamic rules and principles and International Law concepts, with the help of experts. This not only assures the enrichment of judgements of ICJ and its judges’ opinions on Islamic Law, but also creates opportunities for this legal system to be approached in the development of international law and the peaceful settlement of international disputes.
