International responsibility arising from environmental damages is one of the important legal issues that is very effective in regulating relations between governments. The present review of the prevailing legal status of international responsibility arising from climate change in international law shows that although a significant number of international treaties have required the establishment of an international climate change regime as a self-sufficient regime, such regime is not established yet and General rules of international responsibility of the state should be followed in this context. In this regard, the concept of damaging the environment in international law is identified. National and international law need improvement regarding damages arising from climate change, however the lack of improvement is does not prevent the establishment of a regime of state international responsibility for climate change. Applying general rules of international state responsibility and the determination of the international community to establish international state responsibility to prevent public damages of climate change can be stepping stones to creating specific regimes in the matter.
