Application of Lis Pendens Rule in International Parallel Proceedings

Abstract
Today with growth trade and transboundary relations, there is foreign element in most of legal relation, the expansion of transactions and communications in the world trade, despite its undeniable benefits, can be challenging in cases that lead to disagreement because Each party to the dispute seeks to file a lawsuit in a court that his interests are better guaranteed. And this creates parallel proceeding that will have adverse effects on the identification and enforcement of foreign verdicts, Lis pendens is one of the most usual methods for contrast of international parallel proceeding that different countries according the importance give to international judicial cooperative, they have followed different approaches and attitudes on the ability to apply this rule to the international area, the importance point about applicable of Lis pendens rule in the international parallel proceeding That is the use of governments from Lis pendens in parallel proceeding largely depends on the principle of mutual trust between governments, which clearly derives from the historical background of the Brussels Convention and the reforms of this convention.
